What to Expect at Your Divorce Mediation

By Leslie Fineberg on December 8, 2014

A divorce can be a traumatic, mournful time in one’s life, and at Nottage and Ward, LLP we understand the complex challenges that come with the territory. You may think that expensive litigation is your only option for a divorce, but an alternative method is to hire a divorce mediator. Unlike an attorney, a mediator acts as a neutral third party to help you and your soon-to-be-ex-spouse resolve your legal issues.

A mediator will meet with you and your spouse individually and together in order to discuss and resolve the issues of your divorce. Mediation is confidential, with no public record, and allows you to work toward a solution that you and your ex agree is fair for the situation.

It is the mediator’s job to keep the lines of communication open throughout the decision making process. He or she can help brainstorm ideas as well as encourage compassion and understanding.

In addition, mediation helps to eliminate the stress that accompanies court appearances and court dates because you will be on your own schedule and can have more control of the process.  Unlike litigation, mediation is more flexible and confidential. It gives you and your spouse a way to settle conflicts in a way that helps you to work together as parents, if there are children also involved.

Mediation is not a substitute for the services of a lawyer, however. A mediator cannot give any legal advice, and it is strongly advised that you have your lawyer present at your mediating sessions to ensure that your rights are protected every step of the way.

For the most favorable result, couples seeking divorce mediation should seek the counsel and guidance of a trusted Chicago divorce lawyer with vast experience in mediation. At Nottage and Ward, LLP, we have the extensive experience with mediation and can provide the trustworthy and caring advice you need during this difficult process. Contact us today.

Leslie has been the strongest representation I could ask for in a very complicated, emotional matter. She has continuously looked out for my best interest and the best interest of my son. She is always prompt in getting back to me and in keeping me well informed about my case.
